Introduction

Your privacy is important to us. This privacy policy (“Privacy Policy”) describes how Something Different, LLC (“SD” or we” or “us” or “our”) collects, uses, and discloses information with respect to its website (the “Site”).  We want to clearly explain the types of information we gather, how it is maintained, and how to correct or change it. 

This Privacy Policy applies to the information we collect (i) on this Site, and (ii) in email, text, or other electronic messages between you and the Site.  It does not apply to information collected by: (i) us offline or through any other means, including on any other website of SD or any third party; or (ii) any third party, including through any application or content (including advertising) that may link to or be accessible from the Site.

Children Under the Age of 13

Our Site is not intended for individuals under the age of thirteen (13), and we request that these individuals do not provide personal information through our Site. We do not knowingly collect information from children under thirteen (13) without parental consent. Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Site, including your name, phone number, mailing address, email address, IP address, information about you (for example, age, gender, socio-economic status, professional information), data provided by cookies and other similar technologies including your browsing history on our website, functional data such as registration and system data, as well as additional usage data—for instance, your purchasing history, communication permissions, artist preferences and creative interests or information about your attendance at one of our events.

At times, you may be directed to third-party websites and/or offered the option to download an application using a third-party platform. Our provision of a link to any website or our provision of an application using a third-party platform is for your convenience and does not signify our endorsement of such website, platform, or its contents. When you click on such a link or download and use such an application, you will leave our Site and go to another website. During this process, a third-party may collect personally identifiable information from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this privacy policy do not apply to these outside websites or content or to any collection of data after you click on a link to a third party website.   • For any other purpose disclosed by us when you provide the information.

  • To enforce or apply our Terms and Conditions and other agreements, for billing and collection purposes.

  • If we believe disclosure is necessary or appropriate to protect the rights or safety of SD, customers, or others.

We do not share your personal data with anyone else, and we do not sell your data to anybody.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding our use of the personal information you provide to us and have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising.  You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.   • Disclosure of Your Information for Third-Party Advertising.

  • Promotional Offers from SD via email, newsletters, and other communications.  You will always have the right to opt out of receiving promotional emails or other types of marketing or sales communication from us.  If you opt out, you will also have the ability to opt back in at a later date.  If you wish to stop receiving marketing emails from us, please click on the “Unsubscribe” link included at the bottom of an email or electronic correspondence.  We will respect your choice, and will stop sending you promotional emails once you unsubscribe.  It may take up to two weeks to process your request.  Alternatively, you can email us at hi@sdagency.com.

We do not control third parties’ collection or use of your information to serve interest-based advertising.   However, these third parties may provide you with ways to choose not to have your information collected or used in this way.  You can opt out of receiving targeted ads from members of the Network Advertising Initiative (”NAI”) on the NAI’s website.

Information About How Long We Store Your Information

We will store your personal information for as long as necessary.  We are required by law to keep information about financial transactions for the current financial year plus an additional six years.  We may store your information on our databases for reference and to record any preferences you have notified to us, for example in relation to your opt-in status to receive marketing communications.  The information may be retained and used by SD to answer queries or resolve problems, to provide improved and new services, to respect your rights under the GDPR and CCPA, and for any data retention requirements of the law.  This means we may retain information after you cease interacting with SD.  We store your information securely to prevent unauthorized use.

Your Rights Regarding Our Use of Your Personal Information

You can review, edit or ask us to delete your personal data we hold by contacting us directly at hi@sdagency.com. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Data Security

We have appropriate security measures in place to guard against the loss, misuse, or alteration of our users’ information.  Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.  We urge you to be careful about giving out information in public areas of the Site. The information you share in public areas may be viewed by any user of the Site.

Changes to the Privacy Policy

This Privacy Policy is subject to change. We suggest you review the policy from time to time. If we make changes to the Privacy Policy, we will revise the “Last Updated” date at the top of this Privacy Policy. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Site. Your use of the Site following these changes constitutes acceptance of the revised Privacy Policy.
